Penal and Final Provision of RESA or RA 9646

The most striking part of the R.A. 9646  or

 

Real Estate Service Act of the Philippines  

 

Section 39,  Penal and Final Provision states that:

 

 “Any violation of  this Act, including violations of implementing rules and regulations, shall be meted the penalty of a fine of not less than One hundred thousand pesos (100,000.00) or imprisonment of not less than two (2) years, or both such fine and imprisonment upon the discretion of the court. In case the violation is committed by unlicensed real estate service practitioner, the penalty shall be double the aforesaid fine and imprisonment.

 

 In case the violation is committed  by a partnership, corporation ,association or any other juridical person , the partner,  president , director or manager who has committed or consented to or knowingly tolerated such violation shall be held directly liable and responsible for acts as principal or as a co-principal with the other participants, if any.”

The RESA law is very essential especially on the fast growing real estate business. the position of city/muncipal assessor in the local govt units will also be professionalized. but sad to note that only the city/municipal assessor is given the previlege of availing Sec. 20 par. c of the RESA law. What about those holding the position of Local Assessment Operations Officer in the Office of the city/municipal assessor whose function is to assist the municipal/city assessor in the appraisal and assessment of real properties? They are the ones who conduct the regular physical survey to determine that all real properties in the city/municipality are properly appraised.They assist the assessor in the review and formulation of techniques, precedures and polices relative to real property appraisal. In fact the qualifications of a Local Assessment Operations Officer are the same with that of the assessor and he is qualified for the position of a city/municipal assessor if there is an existing vacancy. In my own opinion, an employee holding the position of Local Assessment Operations Officer I, II, or III in the local govt unit particularly in the Office of the City/Muncipal Assessor can be classified under the word "Appraiser" since that is the nature of his work.
